What is careless driving?

Careless driving is a serious traffic charge under Ontario's Highway Traffic Act.

A driver may be charged if police believe the vehicle was operated without proper care, attention, or consideration for other drivers or pedestrians.

These charges are commonly issued  after:

  • Motor vehicle accidents
  • Rear-end collisions
  • Unsafe lane changes
  • Distracted driving allegations
  • Loss of vehicle control

A careless driving conviction may result in:

  • Fines
  • A possible license suspension
  • Significant insurance consequences
  • 6 demerit points upon conviction

Unlike a simple speeding ticket, careless driving is considered a major office in Ontario.

However, every case is different, and a charge does not automatically mean a conviction.

Many careless driving charges may be reviewed, challenged, negotiated, or reduced depending on:

  • Road conditions
  • Witness evidence
  • Officer observations
  • The circumstances the in the incident

Before paying you ticket, understand your options.
